All text, information, graphics, design, and data offered through our Website are collectively known as our “Content”.
Nature of Our Services
Important: Point Rock Group provides assistance and guidance with health insurance enrollment. When you work with our staff, they help you enter your information directly into insurance carrier websites (such as Cigna, TruHealth, SB/A CoOp). Point Rock Group does not collect, store, or maintain your personally identifiable information, Social Security number, health information, or financial data. Your information is entered directly into the carrier’s secure systems and is subject to their terms and privacy policies.
Eligibility
Our Website and Services are intended for use by individuals who are at least 18 years old. By using our Website and Services, you represent and warrant that you are at least 18 years old and agree to obey all the terms of this Agreement.
Acceptance of Agreement
This Agreement is between you and Point Rock Group, Inc.
THIS AGREEMENT CONTAINS WARRANTY DISCLAIMERS AND OTHER PROVISIONS THAT LIMIT OUR LIABILITY TO YOU. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY AND IN THEIR ENTIRETY, AS USING, ACCESSING, AND/OR BROWSING OUR WEBSITE CONSTITUTES ACCEPTANCE OF THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO BE BOUND TO EVERY TERM AND CONDITION SET FORTH HERE, PLEASE EXIT OUR WEBSITE IMMEDIATELY AND DO NOT USE, ACCESS, OR BROWSE IT FURTHER.
Except as otherwise noted, this Agreement makes up the entire and only Agreement between you and Point Rock Group, Inc. and supersedes all other Agreements, representations, warranties, and understandings about our Website, Services, and the subject matter contained herein. However, to use our Website and Services, you may also be required to agree to additional terms and conditions with insurance carriers. Those additional terms and conditions are separate agreements between you and the insurance carriers.
For-Profit Broker Disclosure
Point Rock Group, Inc. is a for-profit health insurance broker. The health plans offered on this website are provided by third-party insurance carriers, including Cigna, TruHealth, and SB/A CoOp. Point Rock Group acts solely as an intermediary to facilitate your connection with third-party insurers and to assist you in the enrollment process. We are not, nor do we intend to warrant ourselves as, a health insurance provider.
All information compiled on this website has been provided to Point Rock Group from the underlying health plan offerors. Point Rock Group makes no representations and warranties about the plans, and each consumer should do his/her own research into which plan is right for them before enrolling. This disclosure is designed to comply with federal regulations and the Tennessee Consumer Protection Act.
Insurance Carrier Agreements Control
When you enroll in health insurance through a carrier’s website with our assistance, you are entering into a direct agreement with that insurance carrier. The carrier’s terms and conditions, privacy policy, and plan documents govern your coverage and your relationship with the carrier. Point Rock Group is not a party to these agreements and has no control over carrier policies, coverage determinations, claims processing, or premium amounts.
Privacy Policy
Our Privacy Policy is considered part of this Agreement and is available on this Website. You must review our Privacy Policy by clicking on the provided link. If you do not accept and agree to be bound by all the terms of this Agreement, including the Privacy Policy, do not use this Website or our Services.
Dispute Resolution
Arbitration
Any legal controversy or claim arising from or relating to this Agreement and/or our Website and Services, excluding legal action taken by us to collect or recover damages for, or obtain any injunction relating to, website operations, intellectual property, and our Services, will be settled solely by binding arbitration following the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim will be arbitrated on an individual basis and will not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration will be conducted in Chattanooga, Tennessee, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. You or we may seek any interim or preliminary relief from a court of competent jurisdiction in Chattanooga, Tennessee necessary to protect our or your rights or property pending the completion of arbitration. Each party will bear half the arbitration fees and costs.
Choice of Law and Jurisdiction
This Agreement will be treated as if it were executed and performed in Chattanooga, Tennessee, and will be governed by and construed following the laws of the state of Tennessee without regard to conflict of law provisions. You agree to submit to the personal jurisdiction and venue of such courts. Any cause of action by you about our Website or Services must be instituted within one year after the cause of action arose or be forever waived and barred.
Limited License
Point Rock Group, Inc. grants you a nonexclusive, nontransferable, revocable license to access and use our Website strictly under this Agreement. Your use of our Website is solely for personal, noncommercial purposes related to obtaining health insurance information and assistance unless otherwise provided for in this Agreement. No printout or electronic version of any part of our Website may be used by you in any litigation or arbitration matter at all under any circumstances.
Legal Compliance
You agree to comply with all applicable domestic and international laws, statutes, ordinances, and regulations regarding your use of our Website, Content, and Services.
Our Relationship with You
No agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship is intended or created by this Agreement or your use of our Website and Services. Point Rock Group, Inc. acts solely as a broker and assistance provider. We do not act as your agent in dealings with insurance carriers, and we do not have authority to bind you or the carrier to any agreement.
Contact Information and Assistance Requests
When you contact us for assistance or request information, you may provide us with basic contact information (name, email, phone number). We use this information solely to respond to your inquiry and provide assistance. We do not collect or store your Social Security number, health information, financial data, or detailed application information.
Representations and Warranties
By using our Website and Services, you represent and warrant that:
- All information you submit to our Website or provide to us is truthful and accurate
- Your use of our Website and Services does not violate any applicable law or regulation
- You will not use our Website or Services for any unlawful purpose
- When our staff assists you in entering information into carrier websites, you will verify that all information is accurate before submitting it to the carrier
- You understand that you are entering into agreements directly with insurance carriers, not with Point Rock Group

All Content included on our Website, such as text, graphics, logos, button icons, images, digital downloads, data compilations, and software, is the property of Point Rock Group, Inc. or its content suppliers and is protected by United States and international copyright laws.

Assistance with Enrollment
When Point Rock Group staff assists you with health insurance enrollment:
- You authorize our staff to view your screen as you enter information into carrier websites
- You understand that you are entering information directly into the carrier’s secure system
- You are responsible for verifying the accuracy of all information before submitting to the carrier
- Your enrollment is subject to acceptance by the insurance carrier
- You agree to pay all applicable premiums and fees as outlined in your plan documents
- You acknowledge that coverage terms, conditions, and costs are determined by the insurance carrier, not by Point Rock Group, Inc.
- Questions about coverage, claims, billing, or policy terms should be directed to the insurance carrier
No Guarantee of Enrollment or Coverage
Point Rock Group provides assistance with the enrollment process but does not guarantee:
That any insurance carrier will accept your application | That you will qualify for any particular plan or subsidy | The accuracy of plan information provided by carriers | That coverage will be in effect by any particular date | That any particular medical provider or facility will be in your plan’s network
All enrollment decisions, coverage determinations, and claims decisions are made solely by insurance carriers.
Errors and Corrections
We attempt to ensure that information on our Website about insurance plans is accurate and current. However, plan details, pricing, and availability are determined by insurance carriers and may change without notice. We make no representation as to the completeness, accuracy, or currency of plan information on our Website.

Cancellation and Changes
Cancellation, changes to coverage, and refund policies for health insurance plans are governed by federal and state regulations and the specific terms of your insurance contract with the carrier. Point Rock Group, Inc. does not determine these policies and has no authority to cancel coverage or approve refunds.
Special Enrollment Periods, Open Enrollment Periods, and plan change windows are determined by federal regulations and individual carriers. Point Rock Group, Inc. will provide information about these timeframes but cannot modify them or guarantee enrollment outside of applicable enrollment periods.
To cancel or modify your coverage, contact your insurance carrier directly.
Indemnification
You agree to indemnify, defend, and hold us and our partners, agents, officers, directors, employees, subcontractors, successors, assigns, and affiliates free from any liability, loss, claim, and expense, including reasonable attorney’s fees, related to:
Your violation of this Agreement | Your use of our Website or Services | Information you provide to insurance carriers | Your enrollment in or use of insurance coverage | Any disputes with insurance carriers
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POINT ROCK GROUP, INC. AND ITS SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES OR INFORMATION.
THIS INCLUDES, BUT IS NOT LIMITED TO: CLAIMS DENIALS, COVERAGE GAPS, NETWORK ISSUES, PREMIUM COSTS, BILLING ERRORS, ENROLLMENT PROBLEMS, DELAYS IN COVERAGE, POLICY CANCELLATIONS, OR ANY OTHER MATTERS DETERMINED BY INSURANCE CARRIERS.
POINT ROCK GROUP PROVIDES ASSISTANCE ONLY. WE ARE NOT RESPONSIBLE FOR INSURANCE CARRIER ACTIONS, DECISIONS, POLICIES, OR FAILURES.
In all cases, Point Rock Group, Inc.’s total liability shall not exceed the greater of the amount you paid for our assistance services (if any), or $1.00 USD.
Severability and Survival
Should any part of this Agreement be held invalid or unenforceable, that portion will be construed consistent with applicable law and the remaining portions will remain in full force and effect. To the extent that any Content is in conflict or inconsistent with this Agreement, this Agreement will take precedence. Our failure to enforce any provision of this Agreement will not be deemed a waiver of such a provision, nor of the right to enforce such a provision. Our rights under this Agreement will survive any termination of this Agreement.
Changes to Our Agreement
We reserve the right to change this Agreement at any time by providing advance notice of the changes by email or by posting on our Website. These changes will become effective 30 days after the notice is posted. Your continued use of our Website and Services after any change to this Agreement constitutes your acceptance of such change. If you do not agree with the changes to this Agreement, you should discontinue use of our Website and Services.

Qualified Health Plans vs. Non-Qualified Health Plans
